Terms of Service

These Terms of Service govern your access to and use of ExamForge, operated by Zaid Al-Jumaily (individual). By creating an account, starting a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you represent that you have permission from a parent or legal guardian.

2) Accounts & Security

You are responsible for your account activity and for keeping your login credentials secure. You agree to provide accurate information and keep it up to date.

3) The Service

ExamForge provides subscription-based access to digital educational tools and content (for example: exams, question banks, explanations, and progress tracking). Features, subscription perks, and services may be added, removed, or modified at any time without advance notice.

4) Payments (PayPal) & Taxes

Subscriptions are paid and billed through PayPal. PayPal handles payment processing, invoicing/receipts, fraud checks, chargebacks, and collection of applicable taxes where required. We do not store full payment card details.

5) Subscription Renewal, Billing, and Cancellation

• Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
• Billing timing: You are charged at the start of each billing period.
• How to cancel: Cancel future renewals through account/billing settings (if available) or by emailing contactexamforge@gmail.com.
• After cancellation: Cancellation stops future charges. You typically keep access until the end of the current paid billing period.

6) Refunds

Refunds for subscriptions are governed by the Refund Policy at /refund-policy. You may request a full refund within 14 days of your initial subscription purchase or renewal payment. After this window, payments are final except where required by law.

7) Credits

Credits are a virtual currency used for AI-powered features such as question generation. By purchasing credits, you agree to the following terms:

• Non-refundable: All credit purchases are final and non-refundable. Credits cannot be exchanged for cash or transferred to another account.
• Expiration: Purchased credits expire 90 days from the date of purchase. Unused credits will be forfeited after this period.
• Bonus credits: Any bonus or promotional credits are subject to the same expiration policy and are non-refundable.
• Monthly subscriber credits: Subscribers receive complimentary monthly credits that expire at the end of each calendar month and do not roll over.
• No guarantees: Credits are consumed based on AI processing costs. We do not guarantee specific outcomes from credit usage.

8) Acceptable Use

• Do not share, resell, sublicense, or redistribute your subscription access.
• Do not copy, scrape, systematically extract, or reverse engineer the Service or content (except where permitted by law).
• Do not attempt unauthorized access, interfere with security features, or disrupt the Service.
• Do not use the Service to violate laws or infringe rights.

9) Intellectual Property

All content and materials on the Service (including questions, explanations, databases, graphics, branding, and software) are owned by us or licensed to us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use while subscribed and in good standing.

10) Beta Service

The Service is provided as a "beta" version and is still undergoing testing and development. You acknowledge and agree that the Service may contain bugs, errors, and other problems. We make no representations or warranties about the completeness, accuracy, or reliability of the Service.

11) Educational Disclaimer (No Medical Advice)

The Service is for educational and informational purposes only and does not constitute medical advice, diagnosis, or treatment.

12) Availability & Changes

The Service is provided "as available." We do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time without notice or liability.

13) Suspension & Termination

We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service or others. You may stop using the Service at any time.

14) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 3 MONTHS (OR €50, WHICHEVER IS GREATER), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

16) Governing Law

These Terms are governed by the laws of the United Arab Emirates, except where mandatory consumer protection laws in your country of residence apply.
